Child Protective Services Investigation
Under Texas state law, anyone who suspects a child of being abused or neglected must report the suspicion to Child Protective Services (CPS) or law enforcement. CPS is then required to investigate all reports. If CPS determines that children are not safe from abuse or neglect, then services are provided. CPS assists parents in providing a safe environment for the children. Parents are taught proper discipline techniques through classes. Many parents participate in counseling sessions as well.
Investigation
A caseworker will be assigned to a case to investigate. The child will be interviewed and examined to check for any signs of abuse or neglect. The interview must be videotaped and may be conducted at any reasonable time and place. If the caseworker needs to transport the child, the parents must be notified.
After the interview has taken place, the parent(s) must be notified within 24 hours of the interview of any allegations that have arisen. The investigator will discuss the report with the parents and attempt to find an explanation for the harm or risk of harm. The caseworker is not allowed to release the name of the person who filed the report. Caseworkers may request medical records, psychological evaluations, and interviews.
Cooperation
It is important that the parents cooperate with the case worker so that the investigation can be completed. If you do not cooperate, the courts will issue a mandate forcing you to comply. The investigation lasts approximately 30 days. After that time, the case worker will determine if abuse or neglect occurred and if the child is at risk of future abuse or neglect.
