Mediation or Arbitration
Proceeding with a divorce can be a difficult experience for couple. Having dedicated so much energy and effort into a relationship, it can be difficult to end that relationship. One of the problems that couples face is how to proceed with a divorce, for there are several avenues they can take.
One avenue is mediation. Mediation involves getting a neutral third party involved in the divorce dispute. The mediator, as the third party is known, acts as a go-between between both spouses, communicating one spouse’s wishes to the other spouse. Moreover, since the spouses will likely have difficulty coming to an agreement over how the divorce proceeds, the mediator offers suggestions and guides the dialogue, trying to meet the interests of both spouses. Ultimately, however, the mediator’s ideas are not binding.
Another avenue that spouses can take is arbitration. Arbitration also involves a neutral third party, but in this case the party is a judge. The judge, also known as the arbitrator, takes in information from both parties, listening to each spouse’s argument and considers each spouse’s situation. The judge then comes to a decision, which is binding. While the judge may try to help the spouses come to an agreement themselves, if this does not happen, the judge will come to a decision for them.
