No-Fault Divorce

Filing for divorce is a much easier process than it was in the recent past. Before divorce laws changed, it was necessary for one spouse to be at fault for a divorce to be valid. In the mid 20th century, as social attitudes began to change, the old divorce laws became problematic. The concept of the “no-fault divorce” was introduced as a solution to these problems.

In the past it was not legally possible for two spouses to make a mutual decision to part ways. One spouse had to accuse the other of some wrongdoing, even if nothing had taken place. In some cases, couples even claimed falsely claimed that adultery had occurred simply to obtain divorces. Courts eventually decided to counteract this problem by introducing no-fault divorces.

A no-fault divorce is simply a divorce in which it is not necessary for either spouse to be found at fault. All that is needed is mutual consent. The first no-fault divorce system was put in practice in 1970, when California became the first state to officially change its divorce laws. No-fault divorce revolutionized the divorce process so greatly that it only took 15 years for every state in the Union to have a no-fault divorce option.

Although these laws make divorce a much less stressful and complicated process than it was in the past, divorces can be very complex undertakings. This is especially true when two spouses have shared debts or shared bank accounts. Child custody introduces its own set of complex issues.
