Texas law, in an attempt to grant equitable treatment and custody decisions, operates from the baseline assumption that children born through the couple’s premarital and marital relationship will remain under the Joint Managing Conservatorship (JMC) of both parents. This arrangement grants the divorcing parents the ongoing legal rights, responsibilities, and obligations associated with parenthood, though it does not relate to the distribution of time with the child. When one parent wishes to relinquish some of that authority or one party is found to be substantially more capable of the management role, a Sole Managing Conservatorship (SMC) may be established instead.

Setting Schedules

Parents love their children very much, so time spent with them is a precious commodity. One of the most difficult effects of a divorce is the reduction of that window. It is an unavoidable reality, so it is best to accept a reasonable division of custodial time rather than to introduce additional stress into a child’s life, unless there are substantial and defensible grounds for pursuing a different arrangement. The state of Texas has a basic Standard Possession Order that seeks to resolve some potential disputes before they arise.

When parents live within 100 miles of each other, the parent who does not have majority custody shall have the child (unless otherwise noted):

  • From 6:00 PM Friday through 6:00 PM Sunday on the 1st, 3rd, and 5th weekends of the month
  • During the two hour window from 6:00-8:00 PM on the birthday of the child
  • For Spring Break, Christmas and the surrounding days

For Thanksgiving and the time from 12:00 PM, December 28th until the day before school starts again
