Restraining Orders

In cases of divorce that follow domestic abuse or violence, the abused party in the relationship may choose to ask a judge to issue a restraining order against the other party in an effort to provide some protection from future abuse.

Restraining orders are orders issued by a court that are intended to protect a person from being harmed more by a person that has hurt another person. They can also be used to keep an abusive individual out of a person’s life or to prevent harassment. This type of order is a civil order that does not give the abusive former spouse a criminal record.

Victims of domestic violence can obtain restraining orders even if there is not a divorce proceeding going on. A victim of domestic abuse is protected by the law. The law says that any person who has been subjected to domestic abuse by a spouse, or any other person who is a present or former household member and where the victim is 18 years of age or older or who is an emancipated minor is eligible to receive a restraining order against his or her abuser.

When a person has been a victim of domestic abuse or violence, a judge can issue a restraining order which is very specific as to what the abusive party may and may not do. One of the most basic orders is one that prohibits the abuser from having any contact with the victim. Other orders prohibit an abusive individual from coming within X number of feet of the victim. Judges have been known to order an abusive party to vacate a home or apartment shared by the couple.
