Sole vs. Joint Custody
One of the most important, emotional, and stressful aspects of a divorce is determining child custody rights. In many divorce cases, the court decides where the children will live based on what the court believes to be in the best interest of the children. However, many people remain unaware that custody issues can be settled outside of court, so it is highly important to consider all of your options when determining child custody issues.
If you are currently undergoing a divorce or contemplating a divorce, you likely have many questions and concerns about child custody. The Frisco child custody lawyers of Alexander & Associates are ready to help you through this emotional time. Differences Between Joint and Sole Custody
The two basic forms of child custody are divided into joint and sole custody. In joint custody, the aim is to have both parents still equally or heavily involved in their children's lives. Joint custody can be divided further into shared legal and/or shared physical custody. With shared legal custody, both parents share the responsibility of important legal decisions for their child, such as education or medical decisions. Shared physical custody means that each parent has the child for at least 35% of the time.
Sole custody differs from joint custody in that only one parent has the decision making authority for their children, and the other parent may or may not have visitation rights.
