The Two Types of Divorce

Divorce is simple concept. It is the official, legal termination of a marriage. In the United States, there are two overarching types of divorce. They are the absolute divorce (also known as divorce a vinculo matrimonii) and the limited divorce (divorce a menso et thoro).

Absolute Divorces

Absolute divorces, as their name suggests, are complete, total divorces. For a divorce to be absolute, the court must terminate it. As a result of absolute divorces, both spouses are no longer legally categorized as married but as single. To get an absolute divorce, there has usually been a requirement of marital wrongdoing, such as adultery or abuse.

Limited Divorces

Limited divorces, as their name implies, are not complete or total. Limitation decrees are often called separation decrees because they involve not dissolving the marital union but simply terminating the couple’s right to live together. A couple that has only been limitedly divorced is still legally married. Some states have a conversion divorce process, whereby a limited divorce will become an absolute divorce after a certain period of time.

No-fault Divorces

No-fault divorces are not technically a different type of divorce but relate to how a divorce can be initiated. Because the requirements for an absolute divorce reflect a different time period, no-fault divorces allow people to get divorces if the couple cannot get along and live together.
