How does the court split property?
The Court will use a “just and right division” to split community assets and debts. The Court can consider any fault or other factors alleged in the Original Petition in determining what a “just and right division” of the community estate. If property is proven to be separate property, the Court will confirm that property as the separate property of that party rather than divide that property as apart of the community estate.
