When can a child decide with which parent they wish to reside with?

The Court will make the decision regarding whom the child lives with using the “best interest of the child” factor. However, at age twelve the child may sign a document indicating with whom they wish to reside and that document can be filed with the Court as evidence of the child’s desire. Each court weighs the document differently, but may or may not side with the child’s desire.
