Mediation is utilized to attempt to reach an agreement without the need for a formal court hearing. A neutral person (usually an attorney) helps to facilitate the parties and their attorney in reaching an agreement. Generally the parties are kept in separate rooms with their attorney and the mediator will go back and forth and try to hammer out an agreement between the parties. Often, the Courts will require a day of mediation prior to a final hearing. Mediation can be referred to as a form of Alternative Dispute Resolution (ADR).
